1. About These Terms

These Terms of Service govern your use of the Modern Goddess Patina website, your purchase of our products and your use of the Momento Archive service.

By using our website, placing an order or using a Momento Archive, you agree to these Terms.

2. Eligibility

You must be legally capable of entering into a purchase contract or have the permission and involvement of a parent or legal guardian.

You must be at least 16 years old to create or independently use a Momento Archive. A user under 16 may use Momento only with the involvement and permission of a parent or legal guardian.

3. Products

We sell two principal journal products:

- Classic Leather Journal, including available fabric folios, accessories and charms
- Momento Leather Journal, which includes the physical features of the Classic Leather Journal together with NFC-enabled Momento functionality

All products are handmade and made to order. Available customisation options may include engraving, folios, accessories and charms.

Product images are provided as accurately as reasonably possible. Screen settings, lighting and natural material variation may cause colours and textures to appear different in person.

Natural leather may show colour variation, grain variation, wrinkles, creases, small marks and patina. These are natural characteristics and are not normally defects.

4. Orders

An order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted or dispatched.

We may decline or cancel an order before acceptance where reasonably necessary, including because of:

- A pricing or product-description error
- Suspected fraud or unauthorised payment
- Inability to obtain materials
- Delivery restrictions
- An unlawful or inappropriate customisation request

If we cancel an order after payment, we will refund the amount paid.

5. Personalised Orders

You are responsible for checking names, spelling, dates and other customisation instructions before placing your order.

We may refuse content that is unlawful, infringing, hateful, threatening, obscene or otherwise inappropriate.

Because personalised and engraved products are made to your specifications, they are normally final sale once production has begun. This does not affect rights relating to faulty or incorrectly supplied products.

6. Prices and Payments

Prices are shown in the currency displayed at checkout and may change without notice.

Payments may be processed using Shopify Payments, Shop Pay or PayPal. Payment services may be subject to the provider’s separate terms and privacy policy.

Where duties and import taxes are displayed and collected at checkout, they form part of the amount payable. Otherwise, local authorities may impose charges after dispatch.

7. Shipping and Returns

Processing, estimated delivery, tracking, customs, unsuccessful delivery and lost-parcel procedures are described in our Shipping Policy.

Cancellation, return, personalised-product and refund conditions are described in our Return & Refund Policy. Those policies form part of these Terms.

8. Momento Archive Service

A Momento Leather Journal may provide access to a digital Momento Archive through its NFC functionality.

Each Momento Archive includes **1GB of storage**, meaning 1,000,000,000 bytes, with no recurring subscription fee.

Storage limits apply to the combined content and technical files associated with the Archive. Available capacity may therefore be slightly affected by thumbnails, metadata and other files required to operate the service.

The service does not promise a particular number of Memory Stamps.

9. Changes to the Momento Service

We may maintain, update, replace or modify parts of the Momento service where reasonably necessary for security, compatibility, legal compliance, performance or continued operation.

Each Momento Archive includes 1GB of storage with no recurring subscription fee. We may update, replace or discontinue parts of the service. Where reasonably practicable, we will provide advance notice of a material discontinuation and an opportunity to export available content.

Nothing in this section removes any remedy you may have where a paid product or service does not conform to applicable consumer law.

10. PIN and Account Security

You are responsible for:

- Keeping your Owner PIN confidential
- Securing devices used to access the Archive
- Ensuring that recovery or contact information supplied to us is accurate
- Promptly notifying us if you suspect unauthorised access

We are not responsible for access caused by your voluntary disclosure of a PIN or failure to secure your device, except to the extent the loss was caused by our failure to use reasonable care or cannot lawfully be excluded.

11. Your Content

You retain ownership of photographs, Voice Notes, titles and other eligible content you upload.

You grant us and our service providers a limited, non-exclusive licence to host, store, copy, process, resize, generate thumbnails from, transmit and display the content only as reasonably necessary to operate, secure and support the Momento service.

This licence ends when the content is deleted from our active systems, subject to reasonable backup retention and legal obligations.

12. Content Rules

You must have the necessary rights and permissions for all content you upload, including photographs or recordings involving other people.

You must not upload or use Momento to store or distribute content that:

- Is unlawful or promotes unlawful conduct
- Infringes intellectual property or privacy rights
- Is hateful, threatening, exploitative or harassing
- Is obscene or unlawfully sexual
- Contains malware or malicious code
- Attempts to interfere with or gain unauthorised access to our systems
- Causes harm to another person or service

We may restrict or remove content, or suspend an Archive, where reasonably necessary to address a serious breach, security risk or legal obligation.

13. Returns and Archive Deactivation

If an accepted Momento return is received and processed, the associated Archive will be deactivated.

You are responsible for exporting content you wish to keep before returning the product. Archive deletion can be requested separately by contacting us.

14. Intellectual Property

Our website design, branding, product photography, text, graphics and other materials owned by us are protected by intellectual property laws.

You may use the website only for personal and lawful purposes. You must not reproduce, sell, scrape, publish or commercially exploit our materials without permission, except where permitted by law.

15. Third-Party Services

Our website and Momento service rely on third-party services such as Shopify, payment providers, hosting providers and delivery companies.

We are not responsible for an independent third party’s acts or services outside our reasonable control. This does not exclude responsibility that cannot lawfully be excluded.

16. Service Availability

We aim to keep our website and Momento services available, but uninterrupted or error-free availability cannot be guaranteed.

Temporary interruptions may occur because of maintenance, security work, software updates, network failures or events outside our reasonable control.

17. Liability

Nothing in these Terms excludes or limits liability for:

- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of rights that cannot lawfully be excluded
- Any other liability that the law does not permit us to exclude

We are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care.

We are not responsible for losses that were not reasonably foreseeable, or for business losses suffered by a consumer using a product primarily for personal purposes.

18. Governing Law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, but if you are a consumer living elsewhere, you retain the benefit of mandatory consumer protections and any right to bring proceedings in your home jurisdiction that applicable law gives you.

19. Changes

We may update these Terms to reflect changes to our products, technology or legal obligations.

The version applying to a product order is normally the version in force when the order was placed. Changes to an ongoing digital service may apply after reasonable notice where appropriate.
